Platform terms of service
The agreement between Creeley Digital Systems, operating CartArchitect, and the business using a CartArchitect account or purchasing a Creative AI Build.
1. Who these terms cover
CartArchitect is operated by Creeley Digital Systems (ABN 59 135 305 460). These terms are between Creeley Digital Systems and the business using CartArchitect's online-shop building tools or purchasing a Creative AI Build. Business correspondence and notices can be sent to Info@creeleydigital.com.au or PO Box 357, Narellan NSW 2567. The version accepted at checkout applies to that purchase.
A person opening a business account must have authority to act for that business and capacity to enter a contract. Keep account and contact details accurate, protect sign-in access, and promptly report suspected unauthorised use.
2. The service and your shop
The service offers a standard shop build and an optional Creative AI Build. Separate recurring hosting and live shopper payments are not part of a Creative AI Build purchase. Features marked as demonstrations or sandbox tests do not accept real customer payments. A saved draft is not a published shop, and a published demonstration is not evidence that payment processing has been activated.
The seller supplies its products, prices, stock, business identity, customer policies and fulfilment arrangements. The seller remains the supplier of the goods or services sold through its shop. CartArchitect's responsibilities for its own platform service are separate and remain subject to applicable law.
3. Fees and renewal
The founding offer is an A$0 standard build and an optional A$49 one-time Creative AI Build. A Creative AI Build is not a subscription. The proposed hosting price is A$49 per month, with no GST added, but hosting does not begin unless a separate recurring checkout is clearly offered and accepted. CartArchitect adds no percentage fee on shop sales; payment-provider charges are separate.
Each checkout states the payable amount and whether it is one-time or recurring. Creating an account, saving a draft, previewing a shop or purchasing a Creative AI Build does not start hosting. Refer to Billing, cancellation and refunds for remedies when a paid service is not supplied as promised.
4. Content, intellectual property and AI
You must hold the rights and permissions needed for material you upload, generate, publish or share. You retain your rights in your original material. You give CartArchitect a limited permission to process, store, display and transmit that material as necessary to provide, secure and support the service you request; this does not transfer ownership of your business or products.
AI output may contain mistakes and may not be unique or eligible for every form of intellectual-property protection. Review it before use. Do not upload confidential third-party material or identifiable people without appropriate authority. The AI content and product-image policy explains product-accuracy requirements.
5. Shop addresses and availability
A demonstration shop address may use an available name under cartarchitect.com.au. A subdomain remains part of CartArchitect's service and is not a transfer of ownership of the parent domain. Reserved names, impersonation and intellectual-property conflicts may prevent a name being used. CartArchitect may require a shop name to change where reasonably necessary to address those issues.
Internet, hosting, payment and AI services may be interrupted. No uninterrupted-service promise, ranking guarantee or revenue guarantee is made. Material incidents should be investigated and customers given practical information about recovery.
6. Safety, suspension and termination
Access may be restricted to address unlawful activity, a credible security risk, fraud or a material breach. CartArchitect will act proportionately, with notice, reasons and an opportunity to respond where lawful and practicable. Immediate action may be necessary to protect people or systems.
Cancellation, data access, retention, outstanding charges and refunds are handled consistently with the billing policy and applicable law. CartArchitect does not claim an unlimited right to change prices, retain payments for services not supplied, or delete a business's data without a legitimate operational or legal reason.
7. Consumer rights and disputes
Nothing in these terms excludes rights, guarantees, remedies or responsibilities that cannot lawfully be excluded, including under the Australian Consumer Law. A seller-responsibility clause does not remove CartArchitect's liability for its own conduct where the law imposes it.
For support, privacy enquiries or complaints, email Info@creeleydigital.com.au, call 1300 386 247 or write to PO Box 357, Narellan NSW 2567. The complaints policy describes the response process. These terms do not impose a mandatory private dispute scheme or attempt to exclude non-excludable Australian rights.
